Terms of Service
These draft terms describe the HTML Hosts website service. "HTML Hosts," "we," and "us" mean the business that operates htmlhosts.com. The legal entity name and mailing address are [to be inserted by counsel].
1. Agreement
If you pay for a site, you agree to the version of these terms that counsel has approved and that we show you before payment. This draft is not that version. The privacy policy, cancellation and refund policy, and acceptable use page are part of the same draft set.
2. Who may use the service
You must be at least 18 and allowed to bind the business you sign up. The service is aimed at local businesses in the United States. Medical practices, law firms, and other uses called out on the acceptable use page are out of scope until counsel says otherwise.
3. The service
We build a preview of a website for a local business and, if you accept, host the live site. The public price is $129 to set up and $89 a month. The month includes hosting, SSL, connection to your existing domain and routine content updates. Domain registration is separate. The live pages are served from Cloudflare's edge.
We do not promise a search ranking, a number of calls, a number of leads, or a place in map results. We do not build an online store and we do not collect card numbers on your site.
4. Previews
A preview is a demonstration. It is not proof that you are a customer, and it is not permission to treat the preview's words as your advertising. If you did not ask for a preview, you may tell us to remove it. Use our contact form. Copyright notices follow the DMCA and takedown page.
5. Fees
Setup of $129 is charged once when the site goes live. $89 is billed each month in advance, in US dollars, while the subscription continues. We show both amounts before you pay. Taxes, if any, are added only after counsel and the payment provider confirm they apply. Card data is entered on the payment provider's page, reached from app.htmlhosts.com/go/<token>/, not on htmlhosts.com.
If a payment fails, we follow the grace process in the cancellation draft. A failed payment does not, by itself, delete your site or take your domain.
6. Your content and your domain
You keep ownership of the content you give us and of your domain name. You grant us a license to host, display, and back up that content for the service. You promise that you have the rights to the words, photos, and marks you ask us to publish. We may refuse material we cannot verify.
Your domain stays at your registrar. We do not require a transfer. We only change the records needed to serve the site, and we leave mail records alone unless you ask, in writing, for a mail change.
7. Edits
You can ask for edits in plain language. This draft does not publish a numeric cap. If a fair-use limit is required, counsel and the product owner must write it here before anyone pays. A security fix or a correction of our mistake is not an "edit" you have to spend.
8. Availability
We aim for the live site to stay available, including when our own office system is down, because the pages are served from Cloudflare's edge. That aim is not a service-level agreement, not a credit schedule, and not a promise of uninterrupted service. Counsel must decide whether any uptime credit belongs in the signed terms. Planned maintenance, your domain or DNS, the payment provider, and events outside our reasonable control are outside that aim.
9. Suspension
We may suspend a site that breaks the acceptable use rules, that we are legally required to disable, or that we reasonably believe is being used to harm people. We will tell the account contact unless the law or the safety of someone else says not to. Suspension is not a bill of sale for your domain.
10. Cancellation
Cancellation is described in the cancellation and refund draft. Read that page before you rely on a refund.
11. Disclaimers
Proposed wording for counsel, not an approved clause: the service is provided as available, and we disclaim implied warranties to the extent the law allows, including merchantability and fitness for a particular purpose. Some states do not allow some disclaimers. Counsel must keep the rights those states require.
12. Limitation of liability
Counsel must write this section. This draft does not invent a damages cap or claim that a cap is enforceable. Proposed topics for counsel: exclusion of indirect damages where the law allows, a cap tied to fees actually paid, and exceptions the law does not let us limit, including injury caused by gross negligence or willful misconduct and rights that cannot be waived. Do not treat any number in this paragraph as the cap. There is no number until counsel sets one.
13. Indemnity
Proposed wording for counsel: you will cover claims that arise from content you supplied, from a claim you asked us to publish, or from your misuse of the service, including a claim that a photo or a sentence was not yours to use. Counsel must set the procedure, the exclusions, and whether our own negligence is carved out.
14. Changes
We will not switch the price of an existing subscription without notice and a chance to cancel before the new price applies. Material changes to these terms need the same kind of notice. A change to this draft in the repository is not notice to a customer.
15. Law and disputes
Proposed, not chosen: the laws of the State of Oklahoma, excluding conflict-of-law rules, and the state or federal courts in Tulsa County, Oklahoma. Counsel must confirm the entity, the venue, and whether any arbitration clause belongs here. This draft has no arbitration clause and no class-action waiver.
16. Contact
Until counsel publishes a mailing address, contact us through our contact form.
